These Website Terms of Use and Terms and Conditions of Sale (hereinafter referred to as the “Terms”) govern the use of the website deimantes.com (hereinafter referred to as the “Website”) and the purchase of products through the Website.

By using the Website, you confirm that you have read and understood these Terms. Before placing an order, you must also review any terms and conditions applicable to the specific purchase.

Deimantes.com is an online store offering original artworks and other creative products.

The Website may offer:

• art prints;

• original artworks;

• handmade jewellery;

• T-shirts featuring original illustrations;

• other original and creative products listed on the Website.

3. Products and Product Descriptions

3.1. The description of each product provides information about its main characteristics, size, materials, colours and other relevant information, where applicable.

3.2. As some products are original works of art and/or handmade, the appearance of individual items may vary slightly. Such minor variations resulting from the handmade production process shall not be considered defects, provided that the product corresponds to its description.

3.3. Colours shown in product photographs may differ slightly from the actual colours due to differences in the settings of monitors, phones and other display devices.

3.4. The Seller reserves the right to change the product range, descriptions, prices and availability. The information applicable to an order shall be the information provided at the time the order was placed.

4. Original Works and Intellectual Property

4.1. All illustrations, drawings, artworks, photographs, texts, graphic elements, logos, designs and other content displayed on the Website are protected by copyright and other intellectual property rights.

4.2. All rights to artworks and designs created by Deimantė Čėsnaitė belong to the author, unless otherwise agreed in writing.

4.3. By purchasing a physical artwork, art print, garment, piece of jewellery or other product, the Buyer does not acquire any copyright or other intellectual property rights in the underlying artwork.

4.4. Without the author’s prior written permission, it is prohibited to:

• copy or reproduce works displayed on the Website;

• scan, reprint or otherwise reproduce original works;

• use the works for commercial purposes;

• sell or distribute copies of the works;

• use illustrations, drawings or other Website content to create derivative commercial products.

4.5. The Buyer is granted the right to use the purchased physical product for personal purposes; however, this does not grant the Buyer the right to use the artwork incorporated into the product as a separate intellectual property asset.

5. Placing Orders

5.1. To purchase a product, the Buyer selects the desired product, its variant and quantity, and adds it to the shopping cart.

5.2. The Buyer provides the information required for ordering and delivery and selects an available payment and delivery method.

5.3. Before placing an order, the Buyer has the opportunity to review and correct the information provided.

5.4. The Buyer is responsible for ensuring that the contact and delivery details provided are accurate.

5.5. By placing an order, the Buyer confirms that they have read these Terms and agree to comply with them.

5.6. An order confirmation may be sent to the email address provided by the Buyer.

6. Prices and Payment

6.1. All prices displayed on the Website are in euros (EUR).

6.2. Delivery costs, where applicable, are indicated separately before the order is confirmed.

6.3. The final order total is presented to the Buyer before the order is confirmed.

6.4. Products may be paid for using the payment methods available on the Website at the time of purchase, including:

• bank transfer;

• Paysera;

• PayPal;

• Stripe.

6.5. If payment by bank transfer is selected, the payment details will be provided to the Buyer during the ordering process or in the order confirmation email.

6.6. Orders paid by bank transfer will be processed once the Buyer’s payment has been received and identified, unless otherwise stated in the order information.

6.7. Payments made through Paysera, PayPal or Stripe are processed by the respective payment service providers in accordance with their applicable terms and privacy policies.

6.8. The Seller is not responsible for technical disruptions arising from the operation of third-party payment systems but will take reasonable steps to resolve payment-related issues.

8. Returns and Refunds

Information regarding product returns, the 14-day right of withdrawal, applicable exceptions and the refund procedure is provided in a separate Returns Policy.

9. Made-to-Order and Custom Products

9.1. Some products may be made or prepared according to the Buyer’s individual selection or order.

9.2. If a statutory exception to the right of withdrawal applies to a particular product due to its being made to the Buyer’s specifications or clearly personalised, the Buyer will be informed of this before placing the order.

9.3. The possibility of cancelling an order for a custom-made product may also depend on whether production of the product has already commenced.

10. Product Quality

10.1. The Seller aims to ensure that all products correspond to their descriptions and are suitable for their intended purpose.

10.2. If the Buyer receives a damaged, defective or incorrect product, the Buyer should contact the Seller as soon as possible at d.cesnaite@gmail.com and provide information about the issue.

10.3. The Buyer’s statutory rights in relation to defective or non-conforming products are not limited by these Terms.

11. Use of the Website

11.1. The Buyer agrees to use the Website lawfully and not to infringe the rights of others.

16.2. The Seller aims to resolve disputes amicably and as promptly as possible.

16.3. If a dispute cannot be resolved amicably, the consumer has the right to use the consumer protection and dispute resolution remedies provided for under the laws of the Republic of Lithuania.
